Steve and Carole are sick of the Canadian winters and want to move to Arizona to spend more time with their grandchildren. They are excited and ready, but worried about the tax ramifications given that they have a significant estate in Canada! David A. Altro recommends tax planning before they become non-residents to avoid departure tax in Canada. He also suggests many other aspects to consider to avoid incurring probate and estate tax once they become residents of the US.

Cross border estate planning is necessary since a non-resident alien’s estate tax exemption is only $60000. The nonresident alien must pay estate taxes on his or her United States real estate. Foreign investors of shares of any American company including stocks on the New York Stock Exchange, American Stock Exchange, and NASDAQ must pay estate taxes. Using an offshore trust or Nevada Trust are the two best ways to avoid the tax. Learn more in Brian Dooley, CPA’s book, International Taxation in America.

Democracy Now! – democracynow.org – The US Senate is on the verge of approving President Obama’s controversial tax deal with Republicans. Under the deal, Obama agreed to extend the Bush-era tax cut for the wealthiest Americans and reduce the estate tax in return for a 13-month extension of jobless benefits and a handful of tax credits for low- and moderate-income Americans. Democracy Now! speaks to Pulitzer Prize-winning investigative journalist David Cay Johnston, author of the book, “Free Lunch: How the Wealthiest Americans Enrich Themselves at Government Expense (and Stick You with the Bill).” Watch Part 1: www.youtube.com For the video/audio podcast, transcript, to sign up for the daily news digest, for more coverage of Obama’s tax plan, visit www.DemocracyNow.org. While taxes on the wealthy will decrease under the proposal, some tax experts are predicting taxes on the poor will actually increase. Democracy Now! speaks to Democratic Congressmembers Rush Holt of New Jersey and Raúl Grijalva of Arizona, who say they will vote against the deal. ChicagoRaf asked:

Northbrook estate planning attorney Jay Kaufman, (847) 521-4900, can help you with your IRA and Roth IRA account and all of your estate planning needs. Estate tax exemption is 3.5 million and is set to be repealed in 2010. Government may extend this exemption into 2010. The estate tax is not going to affect most estates. However, most estate plans have been designed when the exemption was $600000 or one million dollars. Most people have estate plans that are estate tax focused, having unintended bad consequences. If your estate plan was designed before 2006, it should be reviewed. In 2010 there is an important tax and retirement planning opportunity. Prior to 2010 conversion to a Roth IRA was limited to people making less than 100000. The Roth IRA is distinguished by the fact that it is complete tax avoidance, not just tax deferral. A Roth IRA can help you avoid taxes and the minimim distribution. This is the best tax shelter available especially in an environment of higher tax rates. In 2010 people who have retirement accounts they will have to take their minimum distributions. You should look at your distribution early in the year. Call Jay Kaufman at (847) 521-4900.

KNOXCOUNTYOHIOcom asked:

Knox County Ohio Auditors office has mailed property owners a Triennial update and residential property owners will see a 6% reduction in their tax appraisals. In many cases the semi annual real estate taxes could be lower than the previous tax bill. Some exceptions to this could be if the property is located in an area where a recent levy has passed and another example would be if the property is already in the CAUV agricultural tax reduction program.
