It’s irrelevant, as the Estate Tax exclusion is currently $2,000,000. It will rise to $10,000,000 in 2010 and fall back to $1,000,000 in 2011 under current law. Very few taxpayers estates ever pay any Estate Tax as most middle class taxpayers have estates worth less than $1,000,000. Estate taxes are the forte of the wealthy, not the typical middle class.
The exclusion of gain on the sale of a personal residence is sacrosanct at this point so it will be irrelevant which party wins in November as far as that is concerned.
